HM Land Registry Guidance: Urgent update for Conveyancers

Electronic transfer deed singing: HM Land Registry have released an update to practice guidance around the electronic signing and witnessing of Transfer Deeds. These changes will make it even easier for your clients to complete the deeds electronically and make registration effortless and easier than using a wet-signed deed.

 

The main change is as follows:

Previously the purchaser’s conveyancer needed to supply a completion certificate upon registration to confirm the process had been utilised in accordance with the Land Registry’s guidance. This made adoption a little more difficult as it is the seller’s solicitor/conveyancer that has knowledge of the system being used. However, now the Land Registry have addressed this point with this update and the Sellers solicitors/conveyancers can provide the completion certificate rather than the purchaser’s conveyancer. The completion certificate is just a simple statement that accompanies the Transfer Deed upon registration.
